What are “rights,” properly speaking? And what is the nature of our constitutional rights—specifically, what rights are protected by the Constitution of the United States? In this two-part talk, David Mayer will discuss the nature of constitutional rights, both generally and specifically. Part II will examine the true meaning and scope of most of the particular rights protected by the Constitution, both the enumerated rights and the most significant unenumerated rights. Part II will conclude with a summary of the Supreme Court’s record of ineffectual protection of individual rights.
