This talk will be on “judicial activism” and the application of protesting law in the courts. George Lambert will recount his experiences as a legislator fighting bad laws in the legislature, the executive branch, and the courts, in an attempt to bring them into constitutional compliance. The talk will educate the audience on a) the Presumption of Constitutionality, b) the effect of a Supreme Court decisions on present and future law, c) understanding the risks and rewards of a judicial challenge, d) the process for effective Supreme Court challenges, and e) the issues around “despised litigants” and arguments that lawyers will not make.
